Historic Ruling: Thirty Websites Transmitting Illegal Content Now Blocked

On June 27, 2022, different television channels and audiovisual content creators requested a self-satisfying injunction against those ultimately responsible for the thirty most popular websites illegally redistributing television content. To implement the blocking, they requested the federal court to order all Internet service providers registered before the Argentine Communications Agency (ENACOM) to block access to these websites in Argentine.

This request was filed, among others, by DirecTV Argentina S.A., Imagen Satelital S.A., La Liga Nacional de Futbol Profesional, Win Sports S.A.S., Discovery Networks SL and Supercanal S.A., on the grounds that –through the reported websites– the co-plaintiffs’ intellectual property rights, related rights, and other rights on the transmission of television signals and on audiovisual content they own were infringed and defrauded.

The First Instance Court in Federal Civil and Commercial Matters No. 2 of the City of Buenos Aires considered that the infringements reported were proved, noting that each of the reported sites infringed or facilitated the infringement of copyright, and the illegal transmission of the plaintiffs’ signals and content.

Accordingly, the court granted the injunction and ordered all Internet providers registered before ENACOM to immediately block access from Argentina to the reported websites, and to block all DNS servers under their control.

The co-plaintiffs reserved the right to extend the list of websites, depending on the changing circumstances of the infringement, and considering the volatility of such sites.
