New General Sanctions Regime for Lotteries

The Board of Directors of the Lottery of the City of Buenos Aires SE (LOTBA) issued Board Resolution 33/2025, approving LOTBA’s General Sanctions Regime.


The Regime, which repeals certain prior LOTBA resolutions, applies generally to breaches committed by:

  1. official agency holders,
  2. online gaming agency holders,
  3. the casino vessel operating agent,
  4. the concessionaire of Hipodromo Argentino (for all games operated, administered, and controlled by LOTBA),
  5. manufacturers/suppliers and/or authorized third parties, including component certification laboratories,
  6. any party that may, in the future, enter the activity, pursuant to applicable regulations.


As for the sanctions provided, the Regime contemplates warnings; fines; and revocation or termination of the concession, authorization, license, or contract.

LOTBA is also authorized to adopt preventive measures, such as the partial or total suspension of the alleged offender’s activity, to protect users and bettors. The Regime also includes preventive measures (such as suspension of operations in critical cases) and ancillary measures aimed at raising awareness and promoting best practices.

The sanctioning procedure establishes mechanisms for detecting breaches through inspections, internal reports, or external complaints, with defined timelines for submissions, reviews, and notifications. It also introduces a voluntary payment mechanism that allows offenders to acknowledge the violation and obtain progressive reductions in the applicable fine, based on their compliance records.

Finally, the Regime includes specific provisions depending on the type of activity: gaming halls, horse racing activity, systems, certification laboratories, manufacturers, suppliers, and/or authorized third parties of electronic and/or electromechanical gaming machines, systems, associated devices, and online gaming, among others.
