San Juan Approves Protocol for Using Generative AI

The Province of San Juan approved the Protocol for the Acceptable Use of Generative AI, to modernize the service of justice by implementing technological innovations such as Chat GPT, Gemini, and Copilot, among others. This would allow judges to quicky generate complex texts of legal content and provide support in judicial tasks.

The implementation of the Protocol seeks to preserve the confidentiality, privacy, and integrity of the information, and the compliance with other applicable regulations in relation to information security in the use and deployment of Generative IA.

Another of its main objectives is to ensure agents use GenAI in a responsible way, compatible with the ethical principles and institutional values of the administration of justice, such as impartiality and transparency.

In turn, the Protocol establishes various guidelines for the use of GenAI, including:

1. the prohibition to enter sensitive and/or confidential information into AI systems,
2. the obligation to anonymize data before processing it with GenAI,
3. the obligation to control access to GenAI by those users who have been trained and have specific roles,
4. the prohibition to delegate decisions to GenAI,
5. the obligation to have a human verify results obtained from the GenAI, in all cases,
6. the obligation to report security incidents.

In addition, the Protocol establishes that agents of the judiciary who are authorized to use GenAI must attend the mandatory training the Directorate of Informatics and the Judicial School offer, to learn how to properly use these tools. The use of these technologies will be monitored and audited to ensure compliance with the Protocol.

Finally, non-compliance with the Protocol may result in the imposition of disciplinary sanctions to the agent and/or in the implementation of measures according to the Organic Law of the Judiciary Branch of San Juan.
