New Fiscal Unit Specialized in Cybercrime and Digital Evidence

Resolution No. 007/20 PG provides the Public Prosecutor's Office of Chubut with a structure dedicated to addressing the challenges and difficulties that the complexity of cybercrime demands, with a focus on the training of its members and the permanent technical and technological update in the investigations in cyberspace. It provides that the Fiscal Unit Specialized in Cybercrime and Digital Evidence will include the following cases: i) those included in art. 128 of the Criminal Code; ii) grooming committed by networks, attacks on networks or systems, denial of service, sensitive systems; and iii) scams or frauds and Ransomware (as is typified in the Criminal Code), when the main or accessory commission of criminal conduct includes the use of computer systems, with special attention in the field of organized crime and crimes in which it is necessary to conduct research in digital environments, even if they have not been committed against or through a computer system.

Likewise, it determines that the Fiscal Unit Specialized in Cybercrime and Digital Evidence will have the function of: i) forming information networks, establishing collaboration agreements with service providers and national or provincial organizations in terms of the matter; ii) intervening and participating in national and international networks to combat cybercrime and permanent contact with other prosecutors specialized in cybercrime of the Nation, the City of Buenos Aires and other provinces and agencies dependent on the Argentine Executive h with interference in the matter; iii) participating in awareness campaigns on cybercrime, cybersecurity and social prevention mechanisms; iv) officiating as a consultative and advisory body to all Fiscal Offices in handling digital evidence regarding any case under investigation or trial; v) advising Prosecutors on technological resources and technical support tools, laboratories, research methods, collect, analysis and preservation of evidence available in the country; vi) developing studies on necessary regulatory and legislative reform; vii) preparing reports and diagnoses on cybercrime; and viii) developing cooperation, dissemination and training activities on cybercrime.

However, it delays the effective implementation until the budgetary conditions of the Public Prosecutor's Office improve.

Similarly, through Resolution No. 224/20, the General Prosecutor of the Public Prosecutor's Office of Chubut ordered the creation of a team specialized in cybercrimes. It also stipulates the presentation of quarterly reports aimed at assessing the amount of cases being handled, their development, management rates and development of the team.
