The Argentine Access to Public Information Agency issued a new regulation modifying the data base registration and renewal procedure.

New Resolution about Personal Data Base Registry

The Argentine Access to Public Information Agency, the controlling authority of Personal Data Protection Law No. 25,326, issued Regulation No. 132/2018 and established a new procedure for the registration and renewal of public or private data bases.

The Regulation was published in the Official Gazette on October 22, 2018, and aims to accelerate and simplify the process of registration, updating and elimination of personal data bases.  

The most significant change is that all proceedings must now be carried out through the Online Procedures Platform (“TAD”) or the Electronic Document Management Platform (“GDE”).

All proceedings are free of official fees, nor do they require annual renewal, and the data controller must inform any supervening modification by means of a sworn declaration to keep the registry updated.

Furthermore, the Regulation states that data controllers that are already registered have a deadline to comply with re-registration which expires on October 31, 2019 for private data bases and February 28, 2019 for public ones.
