New Regulations on Online Gambling and Advertising
The new framework seeks to harmonize national and local requirements on mandatory warnings in online gambling and betting advertisements.
The Secretariat of Industry, Commerce and Small and Medium-Sized Enterprises of the Ministry of Economy issued Resolution 271/2026, published in the Official Gazette on August 6, 2026. The Resolution amended the Annex to Resolution 446/2025 of the former Secretariat of Industry and Commerce and updated the rules applicable to online gambling and betting advertisements.
The Resolution harmonizes the federal framework with local regulations by establishing that, where provinces or the City of Buenos Aires have specific regulations requiring their own warnings and/or disclaimers concerning gambling-related risks and the prohibition of minors participating in gambling activities, the federal requirements may be deemed satisfied by complying with the applicable local regulations, if the technical display specifications and display requirements established under the federal regulations are observed.
The Resolution also clarifies certain technical requirements applicable to the display of disclaimers and warnings:
- They must be displayed within the margins of the “safe zones,” appear at the bottom of the advertising material, and have a height of at least 10% of the advertisement’s total height.
- They must be displayed in clearly visible, bold, horizontally oriented typeface, and use contrasting colors to ensure proper visibility.
- They must remain continuously and permanently displayed throughout the entire advertisement.
- In content produced by influencers or during live streams, they must remain displayed for the entire time during which reference is made to the manner of participating in and/or accessing gambling and betting websites.
- In radio advertisements, they must be included at the end of the advertisement in a clear, audible and understandable manner, without background music, and must not be read at a faster pace than the main body of the advertisement.
The Resolution also introduced a new article 8 bis into Resolution 446/2025, allowing the gambling and betting regulatory authorities of the provinces and the City of Buenos Aires to adhere to the terms of the federal framework.
The measure became effective on August 6, 2026, the day it was published in the Official Gazette.
Lastly, all provisions of Resolution 446/2025 that are unrelated to online gambling and betting remain in full force and effect without amendment.
