New Advisory Commission on the Fight against Cybercrime
Within the framework of the Federal Plan for the Prevention of Technological Crimes, established by the Argentine Ministry of Security, the Undersecretariat of Criminal Investigation and Judicial Cooperation created the Advisory Commission on the fight against Cybercrime.
Through provision No. 655/2020 , the Undersecretariat of Criminal Investigation and Judicial Cooperation, created within the National Directorate on Cybercrime Investigations, the ad-honorem Advisory Commission on the fight against Cybercrime, with the purpose of monitoring the implementation of the initiatives incorporated into the “Federal Plan for the Prevention of Technological and Cyber Crimes (2019 - 2023)”, issued under Resolution No. 977.
The Federal Plan for the Prevention of Technological and Cyber Crimes aims to outline a course of action for the protection of citizens and the implementation of an effective government response against cybercriminals.
The Commission will be coordinated and chaired by the National Directorate on Cybercrime Investigations and must meet regularly at least every two (2) months.
The member composition of the Advisory Commission must be established by the Undersecretariat of Criminal Investigation and Judicial Cooperation. Likewise, experts with recognized experience and prestige in prevention and investigation of technologies that serve to optimize the fight against technological and cybercrimes may be invited to join the Commission, as members.
The commission will provide assistance to the National Directorate on Cybercrime Investigations, among others, in the following aspects:
- Advice on trends, techniques, tools and modalities of cybercrime and possible approach strategies for investigation, analysis and prevention.
- Advice on the development of protocols and strategies to address high technology crimes, including, but not limited to, criminal trends that have as a mean the use of ransomware, malware, botnets, analysis of related crimes or with the participation of cryptocurrencies, among other threats that crime is using according to the evolution and advancement of technology.
- Advice on aspects of legal analysis on obtaining, preservation, chain of custody and presentation of evidence and digital forensics.
- Advice and collaboration with the development of tools, open source and auditable, to be used in the investigation of technological and cybercrimes.
This provision enters into force on the day of its publication in the Official Gazette.
