ENACOM Modernizes ICT Radio Spectrum Fees Regime

The Argentine Communications Agency (ENACOM) issued Resolution 481/2026, published in the Official Gazette on June 6, 2026, which approved a comprehensive update to the Regime of Fees and Charges for Radioelectric Stations, Systems, and Services.

The Resolution aims to modernize the radioelectric fees and charges regime in force for over three decades by updating the applicable calculation criteria, aligning the fee structure with currently operating services, and simplifying the billing and administration processes for radioelectric authorizations.


Among the main amendments introduced, the Resolution:

  • Updates spectrum fees and the calculation formulas applicable to the different radioelectric services and systems.
  • Reduces and reorganizes the number of categories and items the regime covers, eliminating categories corresponding to technologies or services that are currently obsolete and have no active authorizations.
  • Incorporates new categories for radioelectric services and systems not previously contemplated in the regulations.
  • Modifies the payment frequency of certain radioelectric fees to optimize billing and collection processes.
  • Eliminates the annual maintenance fee for parties exempt from paying radioelectric fees.
     

The Resolution also vests the Argentine Directorate of Licenses, Authorizations, and Registries with the power to grant certain exemptions in the administrative act that approves the radiocommunication authorization, subject to compliance with certain conditions.

The Resolution will become effective 90 days after its publication.
