The prices of the products affected by regulations that provide for their reversal, which were mentioned in our article “The Government orders the enforcement of the Supply Act in light of coronavirus” of the Dossier, must be published at the points of sale through listings.

 

To facilitate the control of regulations that provided the reversal of the prices of hand sanitizer  (Resolution 86/2020) and mass consumer products (Resolution 100/2020), the Secretariat of Local Commerce issued Resolution No. 102/2020, by means of which it ordered that all the companies included under such regulations display at their points of sale lists with the corresponding sale prices (Section 1 and 2).

 

The listings must include (i) tax identification number, name and commercial name of the company; (ii) location and full address of the point of sale; (iii) EAN code or equivalent of the product; (iv) sale price as of March 6, 2020, for mass consumer products, and as of February 15, 2020, for hand sanitizer (Section 3).

 

The lists will be considered sworn statements and their misrepresentation or adulteration may be sanctioned under administrative regulations (Supply Law and/or Decree 274/2019 on Fair Trade) and/or criminal regulations (Section 4).
