ENReGE: New Integrity and Transparency Requirement
The Federal Electricity and Gas Regulatory Agency seeks to strengthen integrity and transparency policies among companies in the gas and electricity sectors.
Resolution 199/2026, issued by The Federal Electricity and Gas Regulatory Agency (ENReGE) and published in the Official Gazette on July 2, establishes new measures aimed at strengthening integrity and transparency policies in the regulated gas and electricity sectors.
- Regarding natural gas transportation, distribution licensees, and sub-distributors; and electricity transportation and distribution concessionaires
The Resolution instructs natural gas transportation and distribution licensees, natural gas sub-distributors, and federal-jurisdiction electricity transportation and distribution concessionaires to register before the Registry of Integrity and Transparency for Companies and Entities (RITE), which operates under the Anticorruption Office. These companies will one year to register their integrity programs before the RITE or to demonstrate to ENReGE that they have filed the sworn statement stating that there exist adequate integrity programs as set out in Annex III to Decree 1169/2018.
- Other participants in the gas industry and the electricity market
ENReGE also invites the remaining participants in the gas industry included in Law 24076, as well as agents and participants in the electricity market under Law 24065, to voluntarily join and register before the RITE and to implement integrity programs consistent with the guidelines set out in articles 22 and 23 of Law 27401 on corporate criminal liability. Although participation remains voluntary, the regulator has committed to promoting it for two years following the entry into force of the Resolution.
- Exempt parties
The Resolution exempts from registration those holding integrity programs certified under ISO 37001 (anti-bribery management systems) and ISO 37301 (compliance management systems). These must, nonetheless, notify ENReGE they have such certification.
- Purpose
ENReGE grounds this measure in the need to strengthen transparency and integrity in the regulated sectors, promote enhanced compliance practices, and help prevent corruption in activities that involve ongoing interaction with public agencies. In turn, this is expected to encourage investment in these sectors.
ENReGE emphasizes that the measure aligns with the objectives of Law 27401; the policies the Anticorruption Office promotes; and international standards on integrity, transparency, and regulatory improvement. Accordingly, the Resolution is a regulatory tool intended to promote transparency and integrity standards within the markets under ENReGE's oversight.
