Application form for Collective Marks

The National Institute of Industrial Property (INPI) issued Resolution No P-123/09, published in the Official Gazette on May 29, 2009. By means of this resolution INPI approved the application form to file for a Collective Mark, which are only available to organizations formed by socially vulnerable or unemployed citizens, and only if such organizations have been registered with the "National Registry of Local Development and Social Economy Facilitators".

Principally, the application form has mainly taken into account the fact that the applicant is a social facilitator and lists all the classes in which the applicant may apply for a mark. It also includes a special section where the applicant can identify those classes of no interest.

Furthermore, the resolution mentions the regulations governing the use of the mark and includes an exhibit to identify the products and/or services of interest within the chosen classes.

Law No 26,355, published in the Official Gazette on March 27, 2008 provides the legal basis for the protection of Collective Marks and was regulated by Decree No 1384/2008, published in the Official Gazette on August 29, 2008 (please see “Collective Marks” Marval News # 71 of April 30, 2008). The regulation stated that INPI, as the entity in charge of applying the Collective Mark Law, would issue the now approved application form by the commented resolution.
