Gustavo Giay is the Chairman of Marval O'Farrell Mairal. He has been with the firm since 1995 and joined the partnership in 2003. He currently co-leads the Trademarks, Technology and Intellectual Property group and the Telecoms, Media and Technology (TMT) group, bringing over 25 years of experience advising businesses on trademarks, intellectual property and privacy, as well as on complex issues in emerging technologies. His expertise extends to licensing, franchising and commercial agreements, and he has consistently achieved a Band 1 ranking in the World Trademark Review for the past decade, along with several Client Service Awards recognizing his dedication to client success.

He is also recognized internationally as an expert in technology law, IT compliance, privacy, cybersecurity, cloud computing and digital marketing. He advises multiple Latin American technology unicorns, leveraging his deep understanding of the legal and technical needs of IT companies.

He earned his law degree from the Universidad de Buenos Aires (1994), with a focus on business economics, and an LL.M. from Northwestern University in Chicago (1997). He also completed a postgraduate course in Intellectual Property at the Universidad de Palermo in 2002.

In leadership roles, he served on the Board of Directors of the International Trademark Association (INTA) and as International Board Counsel. He is also the President of the Licensing Executives Society (LES) Argentina and a board member of the TechLaw Group, an international network of technology-focused law firms. He also serves as Co-Chair of the Technology Law Committee of the International Bar Association (IBA) and previously chaired INTA’s Data Protection Committee. Additionally, he is a licensed Intellectual Property Agent and a member of the Argentine Association of Industrial Property Agents (AAAPI) and the International Association for the Protection of Industrial Property (AIPPI).
