The National Congress enacted a Law modifying the Hydrocarbons’ Law
On October 31, 2014 Law No. 27,007 amending Hydrocarbons’ Law No. 17,319 (“Hydrocarbons Law”) was published in the Argentine Official Gazette. Besides amending some aspects of the Hydrocarbons Law mostly linked to the exploration and production of unconventional hydrocarbons, the extension of the concessions and the royalties rates, Law No. 27,007 also modifies the promotional scheme for the industry established under Decree No. 929/13, among other key issues for the sector. In this note, the main amendments made to the Hydrocarbons Law by Law 27,007 are described (see complete article).

This Law amends the Argentine Hydrocarbons Law N° 17,319 (for more information see “National Congress enacted a Law modifying the Hydrocarbons’ Law”).

Resolution No. 208 enacted by the Commission of Planning and Strategic Coordination of the Argentine Plan of Hydrocarbon Investments on 09/25/2014, published in the Official Gazette on 10/03/2014.
This Resolution amends paragraph 5) of point I of the Annex about definitions of Resolution No. 1 of the Commission of Planning and Strategic Coordination of the Argentine Plan of Hydrocarbon Investments, which created the “Program of Stimulus to the Surplus Injection of Natural Gas”.

Resolution No. 803 enacted by the Ministry of Economy and Public Finances on 10/21/2014, published in the Official Gazette on 10/22/2014.
This Resolution substitutes Section 5 of Resolution No. 394 of the former Ministry of Economy and Production, which had set the cut and reference values for hydrocarbons. Section 5 will be read as follows: “Section 5: if the international value was to be inferior to the reference value, the applicable aliquot will be of forty five percent (45%). For the case of the tariffs of the Nomenclatura Común del Mercosur (NCM) 2709.00.10 y 2709.00.90, if the international price was to be inferior to the reference value, the applicable aliquot will be the one included in Annex III, attached to this Resolution”.

Joint Resolution No. 184 and No. 294 enacted by the Secretary of Commerce and the Argentine Ministry of Industry on 09/30/2014, published in the Official Gazette on 10/02/2014.
This Joint Resolution creates a Provisionary Certificate of Imports for used goods destined to the hydrocarbon industry with which the importer will have the right to use said goods. This certificate will be valid for 180 running days as of the date of issue. The conditions for the granting of this certificate are established in this Resolution.
Province of Chubut
Resolution No. 21 enacted by the Ministry of Hydrocarbons of the Province of Chubut 10/02/2014, published in the Official Gazette on 10/24/2014.
This Resolution repeals Resolution No. 10, which regulated the Provincial Registry of Oil Companies, and Resolution No. 8, which extended the effects of the initial registry in the Provincial Registry of Oil Companies, both of the Secretariat of Hydrocarbons and Mining of the Province of Chubut, and it approves the new regulation of the Provincial Registry of Oil Companies, according to Decree No. 1292, which created said Registry. Said regulation establishes the common requirements for the registry in the Provincial Registry of Companies that participate in the value chain of the hydrocarbon area of the Province of Chubut.

“YPF confirmed investments to look for oil in Jachal”, published by El Inversor Energético y Minero on 10/10/2014.
YPF, the Argentine state-owned Company, confirmed a USD 235,000 investment in oil explorations in Jachal, Province of San Juan. The works will include mapping and analysis of information gathered. The final report will be submitted in December 2015.
“Given the oil and mining industries, the best salaries are in Patagonia”, published by Revista Petroquímica on 10/10/2014.
Patagonia is the region where private workers receive the highest salaries of Argentina. This condition is explained, mainly, by the influence of the extractive activity within the economy of the Patagonia. In fact, the workers of “Exploitation of mines and quarries” and “Electricity, Hydrocarbons and Water” stand out with the highest salaries.
“New wind farms will be built in the provinces of Buenos Aires and La Pampa”, published by Revista Petroquímica on 10/16/2014.
The provinces of Buenos Aires and La Pampa will host new electric energy entrepreneurships harvesting wind power. Both initiatives will harvest 300 megawatts of power and will demand a USD 600 million investment. ABO Wind, the German firm, will carry out the project La Banderita in the Province of La Pampa, which will count with 25 auto-generators of 2 Mw each. Valued at USD 100 million it will result in 50 Mw of clean energy. Meanwhile, in the Province of Buenos Aires, the Company IMPSA (Province of Mendoza), will build and start a 250 Mw wind farm with a USD 500 million investment.
“San Luis already has its own Solar Panel Farm”, published by Jornada Online (Province of Mendoza) on 10/23/2014.
The Province of San Luis inaugurated its first Solar Panel Farm located in “Terrazas de Portezuelo”, and it will allow big scale production of clean and renewable energy demanding a USD 4.5 million investment. San Luis will become the second Argentine Province to have a solar panel farm, and the first to invest its own money in the project with neither fiscal nor financial incentives.
“PAE obtained a 98.5 million dollar loan to invest in Patagonia”, published by El Inversor Energético y Minero on 10/17/2014.
Pan American Energy (PAE), the oil company, obtained an international loan for USD 98.5 million which will be destined to finance part of its investment program of oil and gas exploration and production. The acquired equipment by PAE is part of its USD 1,500 million investment program for 2014. This will allow them to increase both conventional and unconventional hydrocarbon production.
“Vaca Muerta will make a USD 65 billion annual contribution to the Argentine economy”, published by El Inversor Energético y Minero on 10/17/2014.
According to a report by the consultancy company Accenture, the hydrocarbon deposit of Vaca Muerta will contribute between USD 62,200 and 67,800 billion to the Argentine economy, with an impact of 500 thousand jobs. The report quantified the potential of Vaca Muerta for 2035. If the necessary investments and political decisions are made, Vaca Muerta will guarantee self-supply for the 2020-2025 period. To achieve that, Vaca Muerta will need to add 35 thousand wells to the 27 thousand existing ones.
