Violations to pension and labor regulations

By Resolution No 3072 (Official Gazette, March 29, 2011), the Federal Tax Administration has established the mechanism to be followed in the event that serious violations to pension, labor or health and safety at work regulations are detected, which may also mean that crimes are being committed against the freedom of the workers involved, as regulated in Sections 140, 145 bis, 145 ter of the Argentine Criminal Code, the Law on Slave Traffic No. 26.364 and in treaties and conventions of human rights. These provisions are applicable from March 30, 2011.

The procedure involves recording and analyzing the evidence obtained, and, if necessary, applying the appropriate administrative sanctions. Also, if the criminal offenses listed above are detected, the appropriate criminal complaint must be submitted reporting the proceedings to the Attorney Assistance Unit in Ransom Kidnapping and Slave Trafficking, the Ministry of Labor, the Department of Institutional Coordination and Monitoring and the Secretariat of Human Rights.
