Creation of Argentine Antitrust Registry
On October 15, 2019, Provision 75/2019 was published in the Official Gazette, by means of which the Argentine Antitrust Registry was created. This system will operate under the control of the Argentine Antitrust Commission.
On May 15, 2018, Law 27,442 was enacted, updating the Argentine Antitrust Regime. Among the changes proposed, Section 13 of said law and its corresponding regulations established that within 5 days of the notification of an economic concentration, the regulator should publish in its website the non-confidential information contained in the Argentine Antitrust Registry related to said transaction and that any interested party could present the objections they deemed relevant.
In this context the Argentine Antitrust Registry was created to apply the abovementioned rules.
The Argentine Antitrust Registry contains certain information about each case file. In the case of definitive decisions by the competent authority, the Argentine Antitrust Registry will specify the type of process, docket number, file title, date of commencement, type of decision, date of ruling and whether said ruling was appealed, and revoked or modified by the corresponding Court of Appeals.
In the case of economic concentrations, the Argentine Antitrust Registry will specify the date of notification and include a non-confidential description of said operation delivered by the parties involved. This information will be integrated into the register within 5 days of the notification of the transaction and will allow third parties to file the statements and oppositions that are considered pertinent in relation to a given transaction as per the provisions of Article 13 of the Law No. 27,442.
The Argentine Antitrust Registry is available for consultation through the Electronic Document Management System (Sistema de Gestión Documental Electrónica) at the Argentine Antitrust Commission’s entry desk during business hours. Furthermore, it will be updated weekly on the Argentine Antitrust Commission’s website.
