Financial Trust Regime Updated

Financial Trust Regime Updated

General Resolution 1159 of the Argentine Securities Commission (CNV), issued on August 5, 2026, amends the regime applicable to financial trusts and further expanding the use of automatic authorization procedures The main amendments include:
 

  1. It eliminates the Low Impact and Medium Impact Automatic Authorization Regimes. The General Regime (for specifically identified exceptional cases), the Expanded Medium Impact Automatic Authorization Regime, and the Frequent Issuance Regime remain in force. These regimes retain their historical eligibility requirements, and there are no substantial changes to them.
  2. Whenever an issuance qualifies for an automatic authorization regime, it must be processed under that regime. The Resolution eliminates the possibility of opting for the prior authorization procedure.
  3. It amends certain aspects of the General Regime, including the provisions relating to the initial review and control report of the trust assets and the rules applicable in cases where the trust estate is insufficient


The Resolution also provides that applications for new financial trusts initiated before its entry into force that fall within the scope of an automatic authorization regime will be filed away. This will not require a formal withdrawal and it must continue under the applicable automatic procedure.
