This Decree regulates Law 3105, by which a “special mining interest area” is created within the province. Among its provisions, it established that the State Secretary of Mining, the enforcement authority of Law 3105, must prepare a map to delimit the “special mining interest area,” using the information that certain public entities must provide. In addition, the enforcement authority must reject every application for mining rights over metal minerals included in section 3 subsection a) of the Mining Code located outside the “special mining interest area” that were filed after Law 3105 was enforced. Moreover, within a 60-business- day term all applications for mining rights over metal minerals located outside the “special mining interest area” and in the areas excluded by section 2 of this Law, that were filed before Law 3105 was enforced but were not granted at the time must be rendered ineffective.
