Protection of Geographical Indications and Appellations of Origin in the Province of Buenos Aires

On August 29, 2007 Law No 13,717 was published in the Official Gazette of the Province of Buenos Aires. This law provides the legal basis for the protection of Geographical Indications and Appellations of Origin used in respect of the commercialization of agricultural, cattle and food products in a natural state, altered or processed in the Province of Buenos Aires

Protection of Geographical Indications and Appellations of Origin in the Province of Buenos Aires

The Law was enacted according to the provisions of National Law No 25,380 and its amendments, regarding protection of Geographical Indications (GIs) and Appellations of Origin (AOs).

Law No 13,717 establishes that the determination and registration of GIs and/or AOs of agricultural, cattle and food products may be applied for by any individual and/or legal entity engaged in the manufacturing of those products in the respective area.

Law No 13,717 contains the same prohibitions included in National Law No 25,380 as regards the registration of GIs and/or AOs of agricultural, cattle and food products.

Furthermore, it creates the Registry of GIs and AOs of the Province of Buenos Aires and establishes the registration procedure.

The regulations of Law No 13,717 which have not yet been issued will establish the entity responsible for applying this new law, which will receive the applications for registration of GIs and/or AOs. Such entity will represent the provincial interests regarding the recognition of products originating in the Province of Buenos Aires as well as those products of other provinces which are commercialized in Buenos Aires.
