Extension of health emergency and general preventive measures
Health emergency established by law 27,541, extended by DNU 260/2020, is prorogued until December 31, 2022
On December 24, Decree 867/2021 was published in the Official Report, which extends until December 31, 2022 the provisions of DNU 260/2020, its amendments and complementary regulations, introducing some modifications. The latter had established general prevention measures in order to mitigate the health impact of COVID-19 pandemic.
Among other things, it extends the validity of all the protocols in force approved by the provincial authorities and by the Autonomous City of Buenos Aires, which must comply with the new provisions of this decree, as well as introduces adjustments concerning the isolation of suspicious or confirmed cases, close contacts and of people entering the country.
With the extension of health emergency and the maintenance of the protocols for carrying out activities in offices, we understand that the provisions of Resolution 142/2021 of the Ministry of Labor remain in force, which established that remote work in these circumstances may not be considered as a substitute for the written agreement as an expression of the will of the parties required by Law 27,555.
The Decree will be in force from January 1, 2022.
