On August 13, 2009, the Federal Court of Appeals of the Province of Salta rendered a decision in the case "Minera del Altiplano S.A. c. Estado Nacional - PEN y Otros s/ Amparo" (File Nº 345/08), accepting the claim filed by Minera del Altiplano S.A. For further information on this precedent, please see: "A good Court decision".

On September 28, 2009, the Superior Court of Justice of Neuquén rendered an interlocutory decision in the file "Comunidad Mapuche Mellao Morales c. Corporación Minera del Neuquén S.E s/ Acción Procesal Administrativa" (File Nº 2642/09), establishing the following: (i) that the "Civil, Commercial and Mining" justice is competent to judge a claim regarding the declaration of inexistence or annulment of an exploration and purchase option agreement for a mine located in land owned by the mapuche community; and (ii) granted an injunction, suspending the execution of the mining project developing in said area.
