Corte Suprema de Justicia de la Nación, 04/17/2012, “Comunidad del Pueblo Diaguita de Andalgalá v. Province of  Catamarca et al. / amparo ambiental”.
The Diaguita First People’s Community in Andalgala filed an environmental amparo (accelerated proceedings) against Minera Agua Rica LLC (Argentine branch), the provinces of Catamarca, Tucuman, Salta and La Rioja, and the Federal Government, regarding the exploitation of Agua Rica deposit, and requested the immediate cease of activity. However, the Court found the case did not fall within its jurisdiction, as it has not been proved that inter-jurisdictional natural resources are affected and the claim is related to the authority of the environmental police power, which belongs to local authorities.
