The court decided to confirm the precautionary measure ordered by the lower court, which meant the suspension of all exploration, exploitation, construction or operation activity related to the Copahue Geothermal Project and the prohibition of innovating in mining and oil matters within 5 km of the international border with Chile. The measure was based on the precautionary principle and in relation with the determination of the existence of glaciers in the area of the Copahue Vulcano. It establishes the validity of the suspension until the environmental impact report is performed, as is established by General Law on Environment 25675 as well as in Law 26639 on Minimum Standards for the Protection of Glaciers and Periglacier Environment.
