The Ministry of Production, by Resolution N° 235-E/2017, opened the review due to the expiration of the term and change of circumstances of the antidumping measure provided by Resolution N° 298 dated June 14, 2012, from the former Ministry of Economy and Public Finances, on exports to Argentina of paper and cardboard coated by one or both sides with kaolin or other inorganic substances, with or without binder, excluding any other coating, even colored or decorated in the surface or printed, in rolls or sheets of square or rectangular shape of any size, of a kind used for writing, printing or other graphic purposes, free of fibers obtained by mechanical or chemical-mechanical procedures or having a total content of these fibers lower or equal to the 10% of the weight of the total fiber content, according to the following detail: i. In rolls, of a weight larger or equal to 80 per square meter, and lower or equal to 200 grams per square meter, excluding those with a thickness lower or equal to 15 centimeters, metallized, barited, and/or duplex type; And ii. In sheets or strips, of a weight equal or larger to 80 grams per square meter, and lower or equal to 200 grams per square meter, excluding those shipped by the subheading 4810.14, the NCM 4810.19.10, metallized, and/or barited; Excluding paper and paperboard used for the printing of books and magazines imported by publishing companies or importers acting on behalf of third parties who are direct users registered at the Registry of Imports of the Editorial Sector (RISE) created by Resolution ex MEyOySP No. 1.354/92 and regulated by Resolutions ex SIC No.439/92 and 126/92, from Austria, China, Finland and the United States of America, classified under Mercosur Customs Tariff Codes (N.C.M) 4810.13.89, 4810.13.90, 4810.19.89 and 4810.19.90, while keeping the current antidumping measures until the completion of the review.

The company Ledesma S.A.A.I. requested the opening of the review process of the antidumping measure.

The authorities determined a presumptive dumping margin of 140.26% for Austria, 560.61% for China, 541.18% for Finland, and 142.03% for the United States of America.

El Ministerio de Producción, mediante la Resolución N° 235-E/2017, declaró procedente la apertura de examen por expiración de plazo y cambio de circunstancias de la medida impuesta mediante la Resolución N° 298 de fecha 14 de junio de 2012 del ex - Ministerio de Economía y Finanzas Públicas, para las operaciones de exportación hacia la Argentina de papel y cartón estucados por una o las dos caras con caolín u otras sustancias inorgánicas, con aglutinante o sin él, con exclusión de cualquier otro estucado o recubrimiento, incluso coloreados o decorados en la superficie o impresos, en bobinas (rollos) o en hojas de forma cuadrada o rectangular, de cualquier tamaño, de los tipos utilizados para escribir, imprimir y otros fines gráficos, sin fibras obtenidas por procedimiento mecánico, o químico-mecánico o con un contenido total de estas fibras inferior o igual al 10 % en peso del contenido total de fibra, según el siguiente detalle: i. En bobinas, de peso igual o superior a 80 gramos por metro cuadrado, e inferior o igual a 200 gramos por metro cuadrado, excluidos los de anchura inferior o igual a 15 centímetros, metalizados, baritados, y/o los tipo duplex; y ii. En hojas o tiras, de peso igual o superior a 80 gramos por metro cuadrado, e inferior o igual a 200 gramos por metro cuadrado excluidos los despachados por la SUBPARTIDA 4810.14, la NCM 4810.19.10, metalizados, y/o baritados; excluyéndose del producto investigado el papel y cartón destinados a la impresión de libros y revistas importados por empresas editoras o importadores que actúen por cuenta de terceros que sean usuarios directos acreditados en el Registro de Importaciones del Sector Editorial (RISE) creado por la Resolución ex MEyOySP N° 1.354/92 y reglamentado por las Resoluciones ex SIC Nros. 439/92 y 126/92, originarias de Austria, China, Finlandia y Estados Unidos, mercadería que clasifica en la posiciones arancelarias de la Nomenclatura Común del MERCOSUR (N.C.M.) 4810.13.89, 4810.13.90, 4810.19.89 y 4810.19.90, manteniendo vigente los derechos antidumping hasta la conclusión del procedimiento de revisión.

La empresa Ledesma S.A.A.I. solicitó el inicio de examen de la medida antidumping.

Las autoridades calcularon un presunto margen de dumping de 140,26% para Austria, 560,61% para China, 142,03% para Estados Unidos de América y 541,18% para Finlandia.
