Because of the significance and bearing of the subjects addressed, we have highlighted some of them and invite you to read them if you have not yet had the opportunity to do so.   MORE   CONSUMER PROTECTION LAW Advertising of Products and Services: Unification of Regulations The Argentine Ministry of Production consolidated the legal requirements for advertising to a single rule and regulated the offer of information by telephone or online.     INFORMATION TECHNOLOGY AND PRIVACY Argentine Securities and Exchange Commission Issues Communique on Initial Coin Offerings The Argentine Securities and Exchange Commission clarified that —in principle— ICOs are not subject to capital markets’ regulations.   MORE MORE   INFORMATION TECHNOLOGY AND PRIVACY New Regulations for Contests and Sweepstakes Decree No. 961/2017 and Resolution No. 915-E/2017 of the Secretariat of Commerce modified the regulations of the conditions for those who organize or promote contests, draws and sweepstakes with the aim of simplifying certain formalities.     LABOR & EMPLOYMENT Argentine Social Security Reform On December 19, 2017, the Argentine House of Representatives signed into law the Social Security reform bill put forward by the Argentine Executive Power.   MORE MORE   PUBLIC & ADMINISTRATIVE LAW Tentative Bidding Terms for Road Projects under the PPP Regime The Tentative Bidding Terms for the concessions of Stage I of the Highways and Safe Routes project were published.     TAX Exchange of Tax Information Treaty between Argentina and the USA On December 13, 2017, the Exchange of Tax Information Treaty between Argentina and United States of America entered into force.   MORE MORE   TAX Attorney General for Tax Matters Issues Favorable Opinion on Molinos Rio de la Plata S.A. On November 28, 2017, the Attorney General for Tax Matters, Laura M. Monti, filed her legal opinion to the Argentine Supreme Court in the “Molinos Rio de la Plata SA c/ DGI s/ recurso directo de organismo externo” case in favor of the taxpayer´s position. Among other arguments, Ms. Monti underscored that “the honest effort on behalf of taxpayers to minimize their tax burdens is not per se illegal; that is, legal tax savings are not questionable”.     MORE   Marval, O’Farrell & Mairal New Chairman Effective December 12th, Marval, O’Farrell & Mairal has elected Santiago Carregal as its new chairman. Labor Rodrigo Solá Torino was speaker about the Labor Reform for the AmCham HR Committee. Among the issues discussed were the impact, challenges and costs of the Argentine labor reform, possible effects on the labor market and changes in the social security system. Capital Markets Santiago Carregal was speaker at the Jornadas de Actualización sobre Ley de Financiamiento Productivo organized by the Cámara de Sociedades Anónimas, held on December 19, 2017. Por la trascendencia y vigencia de las normas tratadas, destacamos los siguientes y los invitamos a leerlos si aún no lo han hecho.   MÁS   DEFENSA DEL CONSUMIDOR Publicidad de bienes y servicios: Unificación normativa El Ministerio de Producción consolidó en una única norma los requisitos legales para las publicidades y reguló la forma de ofrecer cierta información telefónicamente o por internet.       DERECHO LABORAL Reforma previsional El 19 de diciembre de 2017, la Cámara de Diputados convirtió en ley el proyecto de reforma previsional impulsado por el Poder Ejecutivo Nacional.   MÁS MÁS   DERECHO PÚBLICO & ADMINISTRATIVO Prepliegos para proyectos viales bajo el régimen de PPP Se publicaron los prepliegos de las licitaciones correspondientes a la Etapa I del proyecto de Red de Autopistas y Rutas Seguras.       IMPUESTOS Acuerdo de intercambio de información tributaria entre la Argentina y Estados Unidos El 13 de diciembre de 2017, entró en vigor el Acuerdo de Intercambio de Información Tributaria entre la República Argentina y los Estados Unidos de América.   MÁS MÁS   IMPUESTOS Dictamen de la Procuración General de la Nación favorable a Molinos Río de la Plata SA El 28 de noviembre de 2017, la procuradora fiscal ante la Corte Suprema de Justicia de la Nación Laura M. Monti dictaminó en los autos “Molinos Río de la Plata SA c/ DGI s/ recurso directo de organismo externo”, en favor de la posición del contribuyente. Entre otros argumentos, la procuradora fiscal sostuvo que “… no es reprensible el esfuerzo honesto del contribuyente para limitar sus impuestos al mínimo legal, es decir que el ahorro impositivo legítimo, por sí, no resulta cuestionable”.       TECNOLOGÍAS DE LA INFORMACIÓN Y PRIVACIDAD La CNV emitió un comunicado sobre las “Initial Coin Offerings” (ICO) La Comisión Nacional de Valores aclaró que, en principio, las ICO no se encuentran sujetas a la regulación sobre mercado de capitales, aunque no descartó que ciertas emisiones puedan requerir autorización.       MÁS MÁS   TECNOLOGÍAS DE LA INFORMACIÓN Y PRIVACIDAD Nuevas reglamentaciones sobre concursos y sorteos El Decreto N° 961/2017 y la Resolución 915-E/2017 de la Secretaría de Comercio modificaron la reglamentación de las condiciones para quienes organicen o promuevan certámenes, concursos o sorteos, simplificando ciertas formalidades.     MÁS   Nuevo presidente de Marval, O’Farrell & Mairal Santiago Carregal ha sido elegido presidente de Marval, O’Farrell & Mairal, a partir del 12 de diciembre de 2017. Con más de 30 años de experiencia como abogado, Santiago lidera el Departamento de Bancos y Finanzas del estudio. Asume el cargo que tenía Alfredo O’Farrell, quien se retirará en agosto de 2018.
