Enforcement and effectiveness of the Bilateral Agreement on Residence (Argentina-Brazil’s bilateral operative agreement)

Instrução Normativa No 106, dated July 9, 2007, of the Departamento Nacional de Registro de Comercio was published in the Diário Oficial da União in Brazil in July 17, 2007, setting out the enforcement of the Residence Agreement for Nationals of the Mercosur’s Member States.

Enforcement and effectiveness of the Bilateral Agreement on Residence (Argentina-Brazil’s bilateral operative agreement)

This commentary complements what has been informed in the “Enforcement and Effectiveness of the Bilateral Agreement on Residence” article published in Marval News # 58 on February 28, 2007.

The National Commerce Registry Department (“Departamento Nacional de Registro de Comercio”) resolved that Argentine citizens that obtain the temporary visa according to the above mentioned Agreement, can be appointed or elected for the position of managers of Brazilian companies or cooperatives.

It has also set that those acts can be duly registered before the ruling bodies of businessmen or corporate companies (“Juntas Comerciales”), under Brazilian law, as long as the international rules stated by agreements and protocols executed within the scope of Mercosur are honored.

The Instrução Normativa is in force since July 17, 2007.
