Court Appointed to Hear the Case during the Judicial Recess, Province of La Rioja, 07/18/2012, Intendente Municipal Depto. Famatina – Medida Cautelar de No Innovar

The Major of Famatina has requested a precautionary measure against Energía y Minerales Sociedad del Estado (EMSE) and Osisko Mining Corporation (Osisko), with the object of protecting the area where Famatina mining project is located. The petitioner claimed that the development of the project should be considered an activity banned by Law 26639 (Protection of Glaciers and Periglacial Environment) and Provincial Law 8773 (Protection of Glaciers), due to the alleged existence of glaciers within the area of the project. The judge considered that the request complies with the requirements of plausibility of the rights claimed and danger in the delay, and ordered the temporary suspension of the project.
