SSN Requires Opt-Out Button and More Online Information

Resolution 435/2025 of the Argentine Superintendence of Insurance (SSN) came into effect on August 21, 2025. The Resolution introduces new requirements for insurers operating through digital channels and modifies the Guidelines for Advertising and Signage, approved through Resolution 360/2024.

Resolution 435/2025 establishes that insurers selling insurance through electronic means must include—in a prominent and visible way, both on the homepage of their websites and in their apps—a button that allows policyholders to request cancelling the policy.

The obligation to include an “opt-out button” on the institutional websites had already been introduced through Resolution 685/2021. This obligation had, however, been implicitly repealed through Resolution 158/2025, which replaced article 25 of the General Regulation of the Insurance Activity, although it had not determined the obligation to include the “opt-out button” in apps.

The “opt-out button” must be available for policies purchased through electronic means in these lines:

- automobiles,

- motorcycles,

- homeowners and comprehensive,

- theft and similar risks,

- other property risks,

- personal accidents.

Resolution 435/2025 also establishes that insurers selling insurance through electronic means must provide on their websites and apps:

- The procedure to request a copy of the policy or contractual documentation.

- Instructions for reporting a claim.

The Resolution also maintains the obligation established in Resolution 360/2024 to inform, on the homepage of the institutional website, that the company has a Customer Service Department, and include the name of the person in charge and their substitute, their contact details, and registration number before the SSN.

It remains mandatory to display—in a visible place at the headquarters, branches, and agencies—a sign at the main entrance with information about the Customer Service Department, and to advertise services in a clear and understandable manner.

These obligations do not apply to Workers’ Compensation Insurers (ART), which continue to be governed by a specific regime.
