Import Monitoring System
In order to enhance competitiveness and facilitate international trade, the Prior Import Sworn Statement was replaced by the Import Monitoring System.

On December 22, 2015, the Federal Tax Authority (“AFIP”), published Regulation 3823 (“Regulation 3823”) in the Official Gazette. This Regulation created the Import Monitoring System (“Sistema Integral de Monitoreo de Importaciones” or SIMI after its acronym in Spanish) to replace the Prior Import Sworn Statement (“Declaracion Jurada Anticipada de Importación” or DJAI after its acronym in Spanish) and abrogated Resolutions 3252, 3255, and 3256 which created and regulated the DJAI System.
In 2012, the Argentine government introduced the DJAI System, applicable to almost all imports of goods. Importers had to submit a DJAI electronically, prior to issuing a purchase order, production order or similar document used for documenting transactions abroad. The DJAI System actually worked as a prior approval system, since the purchase order or similar document could not be placed until the DJAI was approved by the relevant agencies that had adhered to the DJAI System.
The SIMI System, that will replace the DJAI System, creates an obligation for importers to submit certain information electronically through the SIMI application. Such information has not been specified yet. According to Regulation 3823, the information submitted to the SIMI System will be available to all government agencies which adhere to the SIMI System (“Agencies”), and those Agencies will have a 10-day term to decide on them. The AFIP will communicate any objections raised by such Agencies to the importer, and the importer will have to answer them before the corresponding Agency. The exceptions, regulations and operation manual for the SIMI System will be published in the SIMI application on the AFIP’s webpage. As from the date of issuance of Regulation 3823, the SIMI application has not been uploaded to the AFIP’s webpage.
Once approved, the SIMI will be valid for 180 calendar days.
Regulation 3823 does not mention what will happen with the DJAS, the Services Prior Sworn Statement created by the AFIP through Regulation 3276 and effective since April 1, 2012
Regulation 3823 is effective as of December, 23, 2015. However, the DJAIs that have been registered prior to such date will remain in force.
