Regulation of aspects regarding health coverage for interns

Law No 26,427 wholly reorganized the regime of educational internships, creating the System of Educational Internships according to the terms of the Educational System for Students attending Higher Education and the Permanent Education of Young People and Adults and Professional Training. Article 15 thereof establishes that interns shall be granted health coverage under the terms of the Law of Workers' Health Care Plans (Law No 23.660).

Resolution No 1225/2009 -published in the Official Gazette on January 4, 2010- was issued within this framework in order to regulate the aspects regarding health coverage for interns.

Said resolution sets forth that interns shall be granted the health services of the health insurance agents according to the regime established by Laws Nos 23,660 and 23,661. Health insurance agents included in Laws Nos 23,660 and 23,661 shall be obligated to give health coverage to interns; and this Health Insurance (obra social) should be the one that corresponds to the main activity declared by employers in Form No 931 of the AFIP. Likewise, they must provide their medical assistance services as from the date the beneficiary is registered, including the family group in the terms to the extent of article 9 of Law No 23,660.

Hence, the contribution by the companies and/or agencies shall equal that established in article 16 of Law No 23,660; i.e., a contribution equal to six per cent (6%) of the intern’s pay. It is also established that the companies and/or agencies will be responsible for paying the contributions in their charge in favor of the Health Insurance (obra social) and the Solidarity Redistribution Fund (Fondo Solidario de Redistribución) through the Integrated System of Pensions and Annuities (Sistema Integrado de Jubilaciones y Pensiones).
