Agency of Access to Public Information’s Recommendations for Protecting Personal Data in Video Conferencing

Following the specific Guidelines for Data Protection for COVID-19, the Agency of Access to Public Information (“AAIP”) developed a series of new recommendations to protect personal data on different video conferencing platforms.

Its main recommendations are:

  • Reading privacy policies and conditions before using mobile applications or platforms. Companies must request consent to process the users’ personal data and it must be expressed clearly and plainly in writing or other similar means.
  • Companies must report in advance the reasons and consequences of data obtentions, as well as possible recipients and, if data is to be stored in a database, the name and contact information of the person responsible for the database.
  • If a video conference is recorded, participants must be notified, explicitly and specifically of the fact that they are being recorded and what their image will be used for.
  • Platforms that provide password protection and rooms or calls are recommended, as are those with an identification (ID) that is only available to participants.

Finally, the AAIP underscored that Data Protection Law No. 25,326 recognizes and guarantees the rights of users as data subjects and that, in the event of non-compliance, claims may be filed with the AAIP.
