Personal Data Protection - Right to access
On September 15, 2008, the Argentine Personal Data Protection Agency (“Agency”) issued Executive Order No 10/2008 establishing that owners and users of public or private databases must include information regarding the rights the Personal Data Protection Law No 25,326 grants to the data-subjects in their websites as well as in any communication or advertising, in particular, in the forms used to collect personal data.
In this respect, owners and users of data bases have to introduce the following rubrics:
a) "The data-subject is entitled to exercise the right of access to his/her personal data for free at intervals of not less than six months, unless he/she proves a legitimate interest, pursuant to Law No. 25,326, Section 14, Sub-section 3”.
b) "The ARGENTINE PERSONAL DATA PROTECTION AGENCY, Controlling Authority of the Law No 25,326, deals with reports and complaints placed in relation to any breach of personal data protection regulations.”
These rubrics must appear in a visible place.
