Suppliers' Obligations May Be Fulfilled Digitally

By means of Provision 619/2024, the Undersecretariat of Consumer Defense and Fair Trading regulated certain sections of Law 24240 on Consumer Defense, establishing that suppliers’ obligations to supply essential information of the product or service (section 4) and to deliver a manual of use, installation, and maintenance of risky goods (section 6) may be fulfilled digitally, providing the access mode printed or adhered to the product or its packaging. 

With this measure, the obligation to deliver documentation exclusively on physical support is repealed, which marks a step towards technological modernization and adaptation to the new dynamics of digital commerce. 

The measure not only optimizes access to information for consumers, but also helps to reduce transaction costs and promotes production and commercial processes. For suppliers, it also implies greater responsibility in terms of ensuring that the digital platforms used to provide information are clear, accessible, and permanent. 

Companies should implement efficient mechanisms to ensure that consumers do not find barriers to access essential information and establish mechanisms if such information requires updating, avoiding potential claims or penalties for non-compliance with the consumer protection regime.
