Obligation in charge of Internet Service Providers

Law No 25,690 was published in the Official Gazette on January 3, 2003, and entered into force on January 12 of the same year.

The law only contains three articles and its purpose is to compel Internet Service Providers companies to “offer blocking software which disables access to certain WebSites while offering Internet services”, regardless of how the hiring of such services is formalized (Article 1).

Article 2 establishes that the National Communications Commission will control the fulfillment of the obligation established in Article 1.

Finally, Article 3 states that the controlling authority will establish the fines to be imposed on those Internet Services Providers companies which infringe the law. Such fines will be used to advertise the existence of the blocking service in the Internet.

It is also expected that any difficulty that may arise from the application of the law should be resolved in the future, as so far the law has not been regulated.
