New Regulations to Protect Digital Identity
On December 13, 2018, the Congress of the City of Buenos Aires passed Law No. 6128, which amended the Misdemeanor Code of the City of Buenos Aires (the “Code”).

In particular, this law introduced a chapter on “Digital Identity”, which includes some new misdemeanors.
One of these is the unauthorized dissemination of intimate images. A provision of the Code now provides that anyone who disseminates, publishes, distributes, facilitates, assigns and/or provides to third parties images, recordings and/or films which are intimate in nature, without consent and through electronic communications, transfer of data, websites and/or any other means of communication, may be punished by a fine ranging from 400 to 1950 fixed units (currently valued at ARS 17.85 each), 15 days of work or 3 to 10 days of arrest.
In addition, the Code now includes a provision which punishes digital harassment. This section states that anyone who harasses someone else through digital means may be punished by a fine ranging from 160 to 800 fixed units, 3 to 10 days of work in public service, or 1 to 5 days of arrest.
Lastly, Law No. 6128 also included in the Code a misdemeanor regarding identity theft. This provision punishes anyone who uses or creates a fake identity with the image or data of another person, through electronic communications, transfers of data, websites and/or any other means of communication, with a fine ranging from 160 to 400 fixed units, 1 to 5 days of work in public service or 1 to 5 days of arrest.
