This resolution establishes the requirements for mining task maps and exploration plans required by Section 4, clause f) of Decree 3.431/93 for the filing in the Registry of Mining Producers

 

This disposition regulates the functioning of public hearings for mining activities in the Province of Neuquén, establishing the requirements for calling and functioning of said hearings. Public hearings are non-binding instruments of participation; therefore the Sub-Secretariat of Environment called a meeting for the people of the area and other third parties to express themselves on a certain mining project.

 

This resolution confirms Resolution 130/2009 which establishes zoning regulations for the prospection, exploration, exploitation and profit of metallic minerals.

 

This decree establishes the formula to calculate royalties on minerals (3% over the value of the extracted mineral), allowing the deduction of the costs required in the first part of the business, except the ones relative to the mineral extraction. The allowed deductible costs are detailed in Section 22bis added to Law No. 24.196 by Law No. 25.161 (enacted by the Federal Congress).

 

This law modifies Law 7909, regarding the "Special Fund for Mining Development" establishing four per thousand of the monthly turnover of individuals or legal persons rendering and/or providing goods to mining companies, located in the Province of San Juan.

 

This law declares the economic emergency of mining companies located in 'Valle Fértil' Department, from 01/01/2009 to 12/31/2009. Therefore, the Executive Power of the Province of San Juan is empowered to raise money from National authorities, to encourage mining activity and to defer taxes and royalties due by mining companies in said area.

 

On 06/25/2009, the House of Representatives of the Province of San Juan enacted Law 8,005
