Members of the Judiciary and the Public Prosecution Office Make a Presentation on the Prosecution of Financial Crimes

On June 29, 2022, Justice Ricardo Lorenzetti (Argentine Supreme Court of Justice) led a talk together with Justice Mariano Borinsky (National Federal Court of Appeals in Criminal Matters), Justice Alejandro Catania (National Criminal Court in Financial Matters), and Pablo Turano (Prosecutor in Criminal Financial Matters).

Members of the Judiciary and the Public Prosecution Office Make a Presentation on the Prosecution of Financial Crimes

The talk addressed the consequences of organized financial crimes, especially the diversion of funds necessary for basic State services. In this sense, they highlighted the need to create autonomous criminal tools to recover the proceedings of the crimes before a conviction.

The speakers also stressed the difficulties in prosecuting financial and customs crimes, when immediate economic considerations outweigh long term criminal policy. In this respect, they explained that the multiplying of “fiscal amnesties” deeply weakens the possibilities of punishing tax crimes.  

Finally, the speakers commented on the critical situation of smuggling and its impact on the National Security, beyond its economic consequences.

In sum, the speakers highlighted the critical importance of fight against financial crimes and the need for legislative tools that facilitate not only the prosecution and punishment of these crimes but also the recovery of ill-gotten gains.
