Spectrum Cap Reduced for 5G Services

On April 24, 2025, the Argentine Communications Agency (ENACOM) published Resolution 611/2025 in the Official Gazette, amending Resolution 1285/2023, article 1, issued by the same agency, which had approved the General Regulations for the Reliable and Smart Telecommunications Service (STeFI).

Through this amendment, ENACOM establishes a new maximum limit for the accumulation of radio spectrum for STeFI, setting it at 150 MHz per licensee for each area of operation. Previously, article 1 established the limit at 200 MHz.

The recitals of Resolution 611 refer to the Regulations on Administration, Management, and Control of the Radioelectric Spectrum—approved by ENACOM through Resolution 682/2023—which provide, among its general principles, for the establishment and enforcement of conditions for using the radio spectrum that encourage competition and promote the entry of new operators into the market.

As in the previous version, Resolution 611 provides that the spectrum assigned to a company, its controlled or controlling entities, whether directly or indirectly, or entities under common control, or entities holding more than 30% of another company's shares (where such participation allows for substantial influence over corporate decision-making) will be considered jointly. Furthermore, these limitations may not be altered through the assignment or transfer of the authorization, leasing, or any other mechanism.
