Financial Information Unit Amends Information Exchange Processes with Foreign Counterparts

On April 18, 2023, the Financial Information Unit (UIF) issued Resolution No. 66/2023, establishing the new information exchange processes carried out with Foreign Counterparts. The resolution seeks to achieve a framework of international cooperation in line with the international standards and best practices of the Financial Action Task Force.

The resolution incorporates a model form for judicial authorities to request information. The aim of the form is to standardize these requests and improve the efficiency of processes, safeguarding the confidentiality of the sources of information when it is transmitted to judicial bodies and/or the General Prosecutor's Office, and efficiently adapting local regulations to international standards on Prevention of Money Laundering and Financing of Terrorism.

To submit the information request, it is necessary to state the purpose for which the information will be used, particularly if it will be used for intelligence or in a judicial process as evidence. It is also necessary to state all the facts motivating the request and to identify the persons or assets involved, among others.

Finally, those in charge of courts, tribunals, or Prosecutor's Offices may request the UIF to enable two users to carry out information requests.

The resolution will be in force as of May 17, 2023, replacing article 10 subsection a) of the Resolution UIF No. 135/16.
