The Argentine Data Protection Authority Enables Database Registration for Foreign Data Controllers

Under the current personal data protection regime in Argentina, it is mandatory to register databases containing personal data subject to the Personal Data Protection Law No. 25,326. Since 2018, data controllers and databases must be registered through the Online Procedures Platform (TAD) or the Electronic Document Management Platform (GDE), which can only be accessed using locally supported means of identification (as for example Tax ID or ID’s reference number). This meant, in practice, that foreign data controllers could not register their databases.

In this connection, the data protection authority published a new online form allowing foreign data controllers to register with the data protection authority (which serves as an affidavit). Through this form, foreign data controllers can now register as data controller. The form requires contact details of the person authorized and/or empowered to file the registration and contact details of the data controller.
