The Agency of Access to Public Information Published its Plan for 2020

The Agency of Access to Public Information presented its annual strategic plan for 2020, in which it described both general and specific objectives, and the actions that will be carried out by each of the Agency’s areas.

The Agency of Access to Public Information Published its Plan for 2020

The Agency of Access to Public Information (the “DPA” after its acronym in Spanish), the controlling authority of Right to Access to Public Information Law No. 27,275, Personal Data Protection Law No. 25,326, and “Do Not Call” National Registry Law No. 26,951, published their Plan 2020 in which it defined the strategic issues that will be tackled by each of the directorates encompassed within the DPA during the present year. 

Regarding personal data protection matters, the National Personal Data Protection Directorate of the DPA (the “NPDPD” after its acronym in Spanish) highlighted the importance of personal data in the digital era, therefore, the NPDPD’s general objective to strengthen its efforts in safeguarding the protection of personal intimacy and privacy, and guaranteeing its security

To that end, the NPDPD indicated the following specific objectives and actions for the year 2020:

  • Reinforce the fundamental protection of personal data through, among other measures, the replacement of Personal Data Protection Law No. 25,326 (“PDPL”); the organization of trainings and events at a national level referred to the integral protection of personal data; and the publication of content related to personal data protection and responsible use of social media.
  • Improve the internal processes and strengthen the NPDPD’s regulations throughout, among other measures, the continuation of the process of review, surveillance, and update of the personal data protection laws pursuant to current international standards and new technologies; the draft of a new resolution on interpretative criteria of the PDPL; and the performance of inspections and investigations on its own initiative to companies and public organisms for potential infringements of the PDPL.
  • Enrich its IT tools to  improve and optimize the processes related to the National Personal Databases Registry; the collaboration with the Informatics and Innovation Directorate in the elaboration of control panels of the NPDPD; and the optimization of the uploading process within the Challenged Identity Documents National Registry.
  • Consolidate collaborative relationships between the directorates of the DPA throughout, among other measures, the collaboration and innovation for the better operation of the services of the NPDPD; the intervention in the presentations required by the National Access to Public Information Directorate; and the provision of legal assistance regarding the elaboration of regulations with a technological focus.

Finally, the DPA highlighted that Plan 2020 has been already approved by Resolution No. 78/2020. However, considering that Plan 2020 was elaborated before the social, preventive and mandatory isolation imposed by the Argentine Executive as a consequence of the COVID-19 pandemic, the execution of the Plan 2020 may suffer certain modifications, which will be informed through the DPA’s website.
