Working hours

Decree-Law No 9,168/78 regulating that work on Sundays and holidays in shops located within the Province of Buenos Aires was not subject to minimum working hours or compensation was overruled.

Working hours

By Decree No 2,813 dated October 19, 2006, the Executive of the Province of Buenos Aires enacted Law No 13,566, overruling Decree-Law No 9,168/78, and vetoed section 2 of the bill passed by the Provincial Legislature that had established that within 90 days as from the enactment thereof, the entrepreneur representatives of the sector and the trade union representing the workers involved would be entitled to determine the regulations governing working hours and rest periods, within the framework of the collective bargaining agreement relating to the relevant business activity and pursuant to the provisions of the Law on Collective Bargaining Agreements.

Law No 13,566 was published in the Official Gazette of the Province of Buenos Aires on November 3, 2006. The overruling will be effective 90 days as from the date of enactment.

It should be noted that Decree-Law No 9,168/78, passed in 1978, established that the owners or managers of any kind of business establishment, with or without public outlets or employees, were authorized to freely determine the working days and hours, the time of opening, closing and the number of opening hours, being entitled to operate on Sundays and holidays without being subject to minimum working hours or being required to close on a business day so as to compensate.
