Impact of COVID-19 on Privacy and Data Protection
Argentine law considers health related information as sensitive data, so special care should be taken when monitoring employees’ health and their (likelihood of) contagion of Covid-19. The Agency of Access to Public Information, Argentina’s data protection authority, recently issued the following recommendations based on Argentine Data Protection Law No. 25,326 (“DPL”), when processing personal data related with Covid-19.
COVID-19: Mobile Application for Consultations

Covid-19 related webinars
On April 3, 2020, Marval, O’Farrell & Mairal, together with the Association of Corporate Counsels Argentina, co-organized a webinar regarding legal implications of covid-19 under Argentine law. Diego Fernández participated as speaker and discussed privacy and data protection implications.

On March 10, 2020 Diego Fernández – current chair of M&A & Privacy Committee of the Latin American Privacy Association (ALAP) – spoke at an event organized in Uruguay by ALAP and Ferrere Abogados, discussing privacy and data protection in Argentina and the joint PIA guidelines issued by the Argentine and Uruguayan Data Protection Authorities.
ASIPI
On March 9, 2020, Diego Fernández participated as speaker during the Asociación Latinoamericana de Propiedad Intelectual (ASIPÎ) meeting in Montevideo, Uruguay. Diego focused on the intersection of IP & Fintech, addressing software issues and privacy regulations, among others.
