The Resolution extends the service that WIPO manages to include trademark and industrial design applications.

National Institute of Industrial Property Extends WIPO's Digital Access Service for Priority Documents

On August 17, 2023, the National Institute of Industrial Property (INPI) issued Resolution No. 262/2023, which includes applications for trademarks and industrial designs to the World Intellectual Property Organization’s (WIPO) Digital Access Service (DAS) for priority documents. Thus, The Resolution broadens the scope of INPI’s Resolution No. 268, issued in 2019, which had implemented the DAS, managed by the WIPO, for priority documents of patents and utility model applications.

The new Resolution –in force since September 1, 2023– expands the scope of Resolution No. 268/2019 in two stages:

  • As of September 1, 2023, the INPI will be able to access the digital service the WIPO provides to consult foreign priority documents.
  • Starting on November 1, 2023, the INPI will have the power to act as a depositary office, by hosting priority documents of trademarks and industrial designs applications, allowing their consultation.
