ENVIRONMENTAL LEGISLATION PUBLISHED IN FEBRUARY, MARCH, AND APRIL 2021
Federal:
Resolution No. 1/2021 issued by the Secretariat of Environmental Policy and Natural Resources. The Resolution approves the “Promotion program for conservation and sustainable use of biodiversity in agroecosystems.”
Resolution No. 93/2021 issued by the Ministry of Environment and Sustainable Development. The Resolution constitutes the Financial and Administrative Trust for the management of the Federal Fire Management Fund.
Resolution No. 80/2021 issued by the Ministry of Environment and Sustainable Development. The Resolution creates a Wetlands Program.
Matanza-Riachuelo Basin:
Resolution No. 45/2021 issued by the Matanza-Riachuelo Basin Authority. The Resolution creates the Basin Environmental Adequacy Network as an institutional network to support the policies implemented by ACUMAR to promote the improvement of the environmental performance of productive and service facilities located within the Matanza-Riachuelo Basin.
Autonomous City of Buenos Aires:
Law No. 6,378. The Law creates an Ecological Compensation System.
Province of Buenos Aires:
Decree No. 81/2021. The Decree creates the Intelligent Monitoring System for the Prevention and Analysis of Hydrometeorological Risk.
Resolution No. 44/2021 issued by the Provincial Agency for Sustainable Development. The Resolution implements the Registry of Sustainable Destination Technologies pursuant to Section 15 of Provincial Law No. 13,592 and Decree No. 1,215/10.
Resolution No. 43/2021 issued by the Provincial Agency for Sustainable Development. The Resolution exceptionally extends for one-year upon expiration the Environmental Aptitude Certificates which expired between March 21 and November 30, 2020.
Resolution No. 28/2021 issued by the Provincial Agency for Sustainable Development. The Resolution establishes guidelines for the new environmental complexity level formula applicable to industrial facilities that have obtained or are processing their Environmental Complexity Level Classification between the entry into force of Regulatory Decree No. 531/19 and its amendment No. 973/20.
Resolution No. 14/2021 issued by the Provincial Agency for Sustainable Development. The Resolution regulates the management and transport of empty phytosanitary and/or domisanitary containers.
Resolution No. 376/2021 issued by the Water Authority. The Resolution approves several extensions: (i) the expiration date of water prefeasibility certificates, authorizations, aptitudes, and permits; (ii) maturity of payment plans, debts for water use fees and for operating inspection and effluent quality control fees; (iii) payments of fines.
Province of La Pampa:
Rule No. 13/2021 issued by the Undersecretariat of Environment. The Rule provides that companies registering phytosanitary products that release, operate, and market their products within the territory of the Province of La Pampa are requested to submit an annual affidavit corresponding to the previous year, stating the total amount of empty containers of phytosanitary products entered into the province and placed in the market.
Province of Rio Negro:
Law No. 5,491. The Law establishes the environmental protection objectives and procedures of the comprehensive solid urban waste management plan.
Resolution No. 147/2021 issued by the Secretariat of Environment and Climate Change. The Resolution replaces the Annex and amends Sections 2 of Resolution No. 641/SAyDS/2016, whereby the provincial registry of liquid fuel retailers, fractionator fuel retailers, fuel retailers to large consumers and lubricant centers is created.
Province of Santa Fe:
Law No. 14,019. The Law defines the provincial public policy in response to climate change.
Province of Jujuy:
Law No. 6,218. The Law regulates the protection of glaciers and the periglacial environment.
Province of Corrientes:
Law No. 6,548. The Law creates a Provincial Wetlands Inventory.
Province of Misiones:
Law XVI-No.133. The Law implements the provincial system of practices and processing for reducing, recycling and re-using electrical and electronic equipment wastes and disused tires.
