The Future of AI Development in Argentina: What Changes Does the Bill to Amend Law 25467 Propose?

In November 2021, Argentina, among the other 192 member states of UNESCO, adopted the Global Ethical Framework for Artificial Intelligence (AI). Thus, the proposal to amend the Law No. 25467 –which had established a regulatory framework for promoting science, technology, and innovation– follows the recommendations the UN and UNESCO issued: to legislate regarding the development of AI, regulating the use of this disruptive technology in an ethical manner.

Although the development of this technology began in mid-2015, it was not until fairly recently that we had access to it. In fact, it was during late 2022 and early this year that there was an exponential increase in the use of AI tools such as ChatGPT.

The three articles that would be incorporated into the law currently in force propose:

  1. establishing that this technology must be governed by two fundamental values and principles: diversity and inclusion, and peace and justice. The underlying idea is that the advancement of AI should ensure that all individuals or groups can participate without distinction, without reducing their decision-making autonomy, and without jeopardizing their individual and collective security,
  2. incorporating the obligation of registering AI systems through the procedures the Scientific and Technological Cabinet (GACTEC) established for that purpose,
  3. ensuring that any individual or legal entity considering itself threatened or harmed by an AI system can file a complaint before the Secretariat of Science, Technology, and Productive Innovation (SETCIP).
