Part time employment

Part time employment

1.    Part time employment definition

Part time employment is theemployment by which individuals are committed to render a certain number of work hours per day or week, less than two thirds of a full time work . Payment for these workers should not be less than the proportionate payment due to a full time worker with the same category or work position.

2.    Amendments to Section 92 third of the Labor Contract Law

Amendments introduced to Law No 26,474 are the following:

a.    Working day: Law No 26,474 establishes that if the working day exceeds two thirds of a full time working day, workers shall be paid a full time wage.

The breach on the limit of the working day hours will oblige the employee to pay a full time wage for the month when the breach occurred, notwithstanding other consequences resulting from the non compliance with this rule.

b.    Contributions to the Social Security System: Contributions of part time workers to medical insurance will be the same as full time workers do, according to their work category.

c.    Maximum Part Time Workers: The Collective Labor Agreement shall determine the maximum percentage of part time workers allowed to each organization.
