National Supreme Court of Justice, 05/27/2014, “Shell CAPSA c/ DGI” (TF 19.382-I)
The National Supreme Court of Justice confirmed a decision of the National Court of Appeals in Administrative Matters. Said decision had established that in a contract in which a participation in a hydrocarbon concession and certain mobile goods were assigned, the value added tax (VAT) was only applicable to transmitted mobile goods.

Superior Court of Justice of the Province of Neuquén, 05/13/2014, “YPF c/ Municipalidad de Rincón de los Sauces” (File. 2713/09) 
The Superior Court of Justice of the Province of Neuquén held unconstitutional Ordinance No. 1,165/09, of the Municipality of Rincón de los Sauces, which prescribed new sanctions applicable to the non-compliance of the mandatory use of oil absorbent blankets or any other superior method in hydrocarbon production stages. This Ordinance reproduced the same sanctions as a Provincial regulation, so the Court concluded that the Municipality exceeded its powers granted by the Provincial Constitution of Neuquén, affecting the mechanisms provided by federal regime for the functioning of legislative powers.

Court of Appeals in the Civil, Commercial and Labor Matters of Comodoro Rivadavia, Division “A”, Province of Chubut, 04/11/2014, “Pintihueque Marcelino Luis c/ Estado de la Provincia del Chubut y otra s/ Medida Cautelar- Prohibición de Innovar” (File. 000135/2014)
Division “A” of the Court of Appeals in the Civil, Commercial and Labor Matters of Comodoro Rivadavia revoked the precautionary measure that suspended the exploration and exploitation of hydrocarbon works in the “El Trébol” deposit. The Court took into consideration that sweet water was not used during the hydraulic stabilization process, but production water instead; also that there were no risks of contamination of the aquifers.

Nation
Resolution No. 390 enacted by the National Secretary of Energy on 04/30/2014, published in the Official Gazette on 05/08/2014.
This Resolution ratifies the “Agreement for the Supply of Biodiesel For Its Mix With Fossil Fuels in Argentina” dated 23 January, 2014,  executed by the Secretariat of Energy and the companies that produce biodiesel in the area. It also establishes how to supply the fossil fuel market with biodiesel, respecting the Regulation and Promotion Regime for the Sustainable Use and Production of Biofuels in Argentina, created by Law No. 26,093.

Resolution No. 529 enacted by the National Secretary on Energy on 05/20/2014, published in the Official Gazette on 05/23/2014.
This Resolution modifies Resolution No. 95 of the Secretariat of Energy, which established the payments for the generator, co-generator and auto-generator agents of the Wholesale Electric Market.

Nation
Resolution 532 enacted by the National Secretary of Energy on 05/22/2014, published in the Official Gazette on 05/28/2014.
This Resolution establishes the obligation of the operators registered in the National Registry of the Petroleum Liquid Gas Industry to adopt all the legal measures needed in the supply chain of the hydrocarbon in order to satisfy the needs of domestic consumption. This Resolution also extends Petroleum Liquid Gas Price Stability Agreement up to December 31, 2014.

Nation
Joint Resolution No. 392 and 108 enacted by the National Secretariat of Energy and the National Secretariat of Agriculture, Livestock and Fishery on 04/30/2014, published in the Official Gazette on 05/12/2014.
This Resolution modifies, from June 1, 2014, the compensations for easements and damages resulted from hydrocarbon activities performed in the Provinces of Chubut, Santa Cruz and Tierra del Fuego and South Atlantic Islands, established by the Joint Resolution No. 114 of the National Secretariat of Energy and No. 31 of the National Secretariat of Agriculture, Livestock and Fishery on December 27, 2011.

Nation
Joint Resolution No. 391 and 107 enacted by the National Secretariat of Energy and the National Secretariat of Agriculture, Livestock and Fishery on 04/30/2014, published in the Official Gazette on 05/12/2014.
This Resolution modifies, from June 1, 2014, the compensations for easements and damages resulted from hydrocarbon activities carried out in the basins called Cuyana and Neuquina (Provinces of Mendoza, Neuquén, Rio Negro, La Pampa, San Juan y San Luis), established by the Joint Resolution No. 115 of the National Secretariat of Energy and No. 32 of the National Secretariat of Agriculture, Livestock and Fishery on 27 December, 2011.

Province of Mendoza
Decree No. 627 enacted by the Executive Branch of the Province of Mendoza on 04/10/2014, published in the Official Gazette on 05/23/2014.
The Decree ratifies the Agreement executed on April 30, 2013, between the Secretariat of Energy of the Ministry of Federal Planning, Public Investment and Services; and the Province of Mendoza, for the Development of Technical studies for Hydroelectric Projects of Large Scale.

Province of Rio Negro
Resolution No. 250 enacted by the Provincial Department of Waters of the Province of Rio Negro on 04/16/2014, published in the Official Gazette on 05/08/2014.
This Resolution establishes that the Petroleum Industry must be included in the royalty payments for the use of public water according to the terms established in Law No. 2,952, which regulates the use of public water.

Province of Catamarca
Decree No. 424 enacted by the Executive Branch of the Province of Catamarca on 04/14/2014, published in the Official Gazette on 05/13/2014.
This Decree ratifies the Agreement for Works of Distribution of Electric Energy executed on March 31, 2014 between the Province of Catamarca and the Ministry of Federal Planning, Public Investment and Services.

Province of Neuquén
Resolution No. 506 enacted by the Secretariat of Environment and Sustainable Development of the Province of Neuquén on 05/12/2014, published in the Official Gazette on 05/23/2014.
This Resolution establishes the obligation to place non-inflammable absorbent and or adsorbent oil organic blankets in the operations of exploration and exploitation of hydrocarbon; and in every activity, construction, perforation, termination and support services to conventional and non-conventional wells. These blankets must extend 1.5 meters on every side of the installations under the devices that contain, transmit or circulate by pressure, oils, lubricants or fluids that may leak from their specific containers (in the equipment, substructures and accessories).

Argentine Oil, Gas & Energy in the media

“The search for oil in the Argentine Sea will continue”, published by La Nación on 05/10/2014.
YPF and Exxon talked about studying alternatives for the exploration of hydrocarbons in the Argentine Sea. YPF included Total to the discussion. The French company is the only specialist in the Argentine Sea, where it developed the deposits of Carina and Aries at the end of last decade, and now develops the Vega Pléyade deposit; all in the Province of Tierra del Fuego.

“Agreements to extend the gas pipelines in the south of Buenos Aires are being signed”, published by Prensa Argentina on 05/16/2014.
The Ministry of Federal Planning, Public Investment and Services headed the signature of an agreement to extend the gas pipelines of Pampeano Oeste and Villarino-Patagones. The agreement for the Pampeano Oeste contemplates an investment of more than USD 8 million and the pipeline will be extended by 10 kilometers. The gas pipeline of Villarino-Patagones will be extended in more than 25 kilometers and it will demand a USD 12.5 million investment.

“Without the participation of YPF, Mendoza received offers for 8 exploratory areas”, published by El Inversor On Line on 05/16/2014.
The Mendoza´s State Owned Energy Company, Emesa, started the technical offering for the request of bids of 8 hydrocarbon exploration areas. Crown Point-Antrim S.A, Medanito and Kilwer-Andes Energía (of the group Vila-Manzano) made offers for the area of Lindero de Piedra;  Alianza-JHP-PetroAP-EMSA, Crown Point-Antrim S.A, Medanito, Roch and Grecoil-Integra (another firm of the entrepreneurs from Mendoza, Vila-Manzano) showed interest in Agua Botada; for Sierra Azul Sur-Calmuco the interested were: Alianza-JHP-PetroAP-EMSA and Grecoil-Integra.
For Puelén and Sierra del Nevado there was only one offer from Pluspetrol-Geopark. In Cerro Manzano C there was also only one offer: the one of Kilwer-Andes Energía. The quorum for Cerro Manzano D and Cerro Manzano F was declared void.

“A Plant of photovoltaic solar panels was inaugurated”, published by El Diario de la República (Province of San Luis) on 05/19/2014.
With an initial investment of USD 3.7 million and 20 new employment positions, LV Energy Lumins, a company that produces photovoltaic solar panels initiated its activities in the Southern Industrial Park of the city of San Luis, Province of San Luis.

“Exxon announced a super-well in Vaca Muerta”, published by El Inversor Energético y Minero on 05/21/2014.
Exxon Mobil exploration Argentina announced the discovery of gas and non-conventional oil in the area of Vaca Muerta, in the Province of Neuquén. “This first discovery made by Exxon in Vaca Muerta is a very positive sign that the presence of shale oil in this area of the Province of Nequén is a very promising non-conventional resource rich in liquids in Argentina”, expressed the President of the company, Stephen Greenlee.

“YPF is confident about finding another Vaca Muerta in Chubut”, published by Ámbito Financiero on 05/22/2014.
The President of YPF, Miguel Galuccio, and the Governor of Chubut, Martín Buzzi, announced the first discovery by YPF of non-conventional hydrocarbons –shale oil and shale gas- in the formation D-129 in the El Trébol deposit, located in Cuenca del Golfo San Jorge, Province of Chubut. Although the real potential of the finding is to be determined, the company and the Province are enthusiastic that the finding could be similar to the one in Vaca Muerta, Province of Neuquén.

“According to the US, Vaca Muerta has gas for 400 years”, published by Claría on 05/25/2014.
Daniel Poneman, Undersecretary of Energy of the United States, said that the reserves of Vaca Muerta “represent a unique opportunity” for Argentina. He also said that “according to our sources, Argentina has reserves of shale gas equivalent to 800 TCF. Nowadays, the country consumes an equivalent of 1.5 TCF (trillions per cubic feet) of gas per year. That could rise to 2 TCF if there were no restrictions, according to local experts. According to the Agency of Energetic Information of the United States, the reserves of non-conventional hydrocarbons, such as Vaca Muerta, could supply the domestic consumption for 400 years.  

“Offers to construct the Chihuido I dam are being opened”, published by El Inversor Energetico y Minero on 05/26/2014.
The Ministry of Federal Planning will open the envelopes with the economic bids for the construction of the Chihuido I dam, on the Neuquén River, which will demand an investment of almost 1,900 million dollars. Companies from Brazil, Russia, United States and China showed interest in this investment. The new dam and hydroelectric dam will be located 155 kilometers from the city of Neuquén and will allow for better flood control; and provide 637 megawatts (Mw) of power.

“Madalena Energy bought the stock options of Gran Tierra in Argentina for USD 63 million”, published by El Inversor On Line on 05/30/2014.
The independent oil company Madalena Energy, with its headquarters in Calgary (Canada), which has concession with non-conventional potential energy in Vaca Muerta, purchased the stock options of Gran Tierra Energy, also a Canadian in Argentina. The operation was for USD 63 million. With a presence in the basin area of Neuquén, where it is exploring the shale of Vaca Muerta, Madalena will now add conventional fields with an estimated of 2,610 daily barrels of oil (78% crude), to its daily offer of hydrocarbons which will ascend to 3,570 bep/d in Argentina, as informed by the company through a press release.

Corte Suprema de Justicia de la Nación, 27/05/2014, “Shell CAPSA c/ DGI” (TF 19.382-I)
La Corte Suprema de Justicia de la Nación confirmó el fallo de la Cámara Nacional de Apelaciones en lo Contencioso Administrativo Federal, en cuanto estableció que un contrato de cesión de participación en una concesión de explotación petrolera, en el que se transmitieron ciertos bienes muebles y un porcentaje de una concesión hidrocarburífera, queda gravado por el impuesto al valor agregado sólo con relación a los bienes muebles trasmitidos.

Tribunal Superior de Justicia de la Provincia de Neuquén, 13/05/2014, “YPF c/ Municipalidad de Rincón de los Sauces” (Expte. 2713/09)
El Tribunal Superior de Justicia de la Provincia de Neuquén declaró la inconstitucionalidad de la Ordenanza N° 1.165/09, de la Municipalidad de Rincón de los Sauces, la cual prescribía un nuevo régimen sancionatorio para el incumplimiento de utilización de mantas oleofílicas u otro método superior en las etapas de producción de hidrocarburos. La Ordenanza reproducía una sanción ya existente en el orden provincial, por lo que el Tribunal entendió que la Municipalidad se había excedido en sus competencias otorgadas por la Constitución de la Provincia de Neuquén, afectando el mecanismo de federalismo de concertación para el funcionamiento de la competencia legislativa.

Cámara de Apelaciones en lo Civil, Comercial y Laboral, de Comodoro Rivadavia, Sala A, Provincia de Chubut, 11/04/2014, “Pintihueque Marcelino Luis c/ Estado de la Provincia del Chubut y otra s/ Medida Cautelar- Prohibición de Innovar” (Expte. 000135/2014)
La Sala A de la Cámara de Apelaciones en lo Civil, Comercial y Laboral de Comodoro Rivadavia revocó la medida cautelar que había suspendido las tareas de exploración y explotación de hidrocarburos no convencionales en el yacimiento “El Trébol”. El Tribunal tuvo especialmente en cuenta que durante el proceso de estimulación hidráulica no se utilizaría agua dulce, sino agua de producción, y que no existía riesgo de contaminación de los acuíferos.

Nación
Resolución N° 390 dictada por la Secretaría de Energía de La Nación el 30/04/2014, publicada en el Boletín Oficial el 08/05/2014.
Ratifica el “Acuerdo de Abastecimiento de Biodiesel Para Su Mezcla Con Combustibles Fósiles en el Territorio Nacional” de fecha 23 de enero de 2014, suscripto entre esta Secretaria de Energía y empresas elaboradoras de biodiesel del sector. Además, establece las pautas a cumplir para el abastecimiento de biodiesel al mercado de combustibles fósiles, en el marco del Régimen de Regulación y Promoción para la Producción y Uso Sustentables de Biocombustibles en el territorio de la República Argentina creado por la Ley Nº 26.093.

Nación
Resolución N° 529 dictada por la Secretaría de Energía de la Nación el 20/05/2014, publicada en el Boletín Oficial el 23/05/2014.
Modifica la Resolución N° 95 de la Secretaría de Energía de la Nación, la cual establece las remuneraciones para los agentes generadores, cogeneradores y autogeneradores del Mercado Eléctrico Mayorista.

Nación
Resolución N° 532 dictada por la Secretaría de Energía de la Nación el 22/05/2014, publicada el 28/05/2014.
Establece que los operadores inscriptos en el Registro Nacional de la Industria del Gas Licuado de Petróleo deben adoptar todos los recaudos legales necesarios en la cadena de suministro de dicho hidrocarburo para asegurar una adecuada satisfacción de las necesidades de consumo interno. Además, prorroga el Acuerdo de Estabilidad del Precio del Gas Licuado de Petróleo hasta el 31 de diciembre de 2014.

Resolución Conjunta N° 392 y 108 dictada por Secretaría de Energía de la Nación y la Secretaría de Agricultura, Ganadería y Pesca de la Nación el 30/04/2014, publicada en el Boletín Oficial el 12/05/2014.

Provincia de Mendoza
Decreto N° 627 dictado por el Poder Ejecutivo de la Provincia de Mendoza el 10/04/2014, publicado en el Boletín Oficial el 23/05/2014.
Ratifica el Acta Acuerdo celebrada el 30 de abril del año 2013 entre la Secretaría de Energía del Ministerio de Planificación Federal, Inversión Pública y Servicios, y la Provincia de Mendoza, para el Desarrollo de Estudios Técnicos de Proyectos Hidroeléctricos de Gran Escala.

Provincia de Río Negro
Resolución N° 250 dictada por El Departamento Provincial de Aguas de la Provincia de Río Negro el 16/04/2014, publicada el 08/05/2014.
Establece que la Industria Petrolera deberá ser incluida en el pago de regalías por el uso de agua pública según lo establecido por la Ley N° 2952, la cual regula el uso de agua pública.

Provincia de Catamarca
Decreto N° 424 dictado por el Poder Ejecutivo de la Provincia de Catamarca el 14/04/2014, publicado en el Boletín Oficial el 13/05/2014.
Ratifica el Convenio Marco para Obras de Distribución de Energía Eléctrica celebrado el 31 de Marzo de 2014 entre la Provincia de Catamarca y el Ministerio de Planificación Federal, Inversión Pública y Servicios.

Provincia de Neuquén
Resolución N° 506 dictada por la Secretaría de Ambiente y Desarrollo Sostenible de la Provincia de Neuquén el 12/05/2014, publicada en el Boletín Oficial el 23/05/2014.
Establece que en las operaciones de exploración y explotación de la actividad hidrocarburífera y en toda actividad de construcción, perforación, terminación y servicios de apoyo a pozos convencionales y no convencionales, se deben colocar mantas orgánicas oleofílicas, no inflamables, adsorbentes y/o absorbentes, las que deberán sobresalir 1,5 metros por lado en las instalaciones, por debajo de los dispositivos que contengan, transmitan o circulen por circuitos a presión, aceites, lubricantes o fluidos susceptibles de fuga de sus contenedores específicos (tanto en equipos, subestructuras y accesorios).

Oil, Gas & Energía argentina en los medios

“Retomarán la búsqueda de petróleo en el mar Argentino”, publicado por La Nación el 10/05/2014.
YPF y Exxon iniciaron conversaciones para estudiar alternativas en conjunto para la exploración de hidrocarburos en el mar Argentino. En el mismo movimiento, YPF sumó a Total a la discusión. La francesa es la única especialista en el mar Argentino. Desarrolló los yacimientos Carina y Aries a fines de la década pasada y ahora tiene en marcha Vega Pléyade, todos en la provincia de Tierra del Fuego.

“Firman convenios para ampliar gasoductos del sur de Buenos Aires”, publicado por Prensa Argentina el 16/05/2014.
El Ministro de Planificación Federal, Inversión Pública y Servicios encabezó la firma de convenios para ampliación de los gasoductos Pampeano Oeste y Villarino-Patagones.  El convenio del gasoducto Pampeano Oeste contempla una inversión de más de USD 8 millones y consiste en la ampliación de 10 kilómetros. El gasoducto Villarino-Patagones será ampliado en más de 25 kilómetros por una inversión de USD 12,5 millones.

“Sin la participación de YPF, Mendoza recibió ofertas por seis áreas exploratorias”, publicado por El Inversor On Line el 16/05/2014.
La empresa provincial de energía de Mendoza, Emesa, realizó la apertura de las ofertas técnicas de la licitación de ocho áreas de exploración de hidrocarburos. Para el área Lindero de Piedra se presentaron Crown Point-Antrim S.A, Medanito y Kilwer-Andes Energía (del grupo Vila-Manzano); para Agua Botada, las empresas interesadas son Alianza-JHP-PetroAP-EMSA, Crown Point-Antrim S.A, Medanito, Roch y Grecoil-Integra (otra firma de los empresarios mendocinos Vila y Manzano) y para Sierra Azul Sur-Calmuco, los oferentes fueron Alianza-JHP-PetroAP-EMSA y Grecoil-Integra. Mientras que para Puelén y Sierra del Nevado sólo se presentó una empresa: Pluspetrol-Geopark. En Cerro Manzano C también sólo hubo una oferta, la de Kilwer-Andes Energía; mientras que la convocatoria en las áreas Cerro Manzano D y Cerro Manzano F se declararon desiertas.

“Inauguraron una planta de paneles solares fotovoltaicos”, publicado por El Diario de la República (Provincia de San Luis) el 19/05/2014.
Con una inversión inicial de USD 3,7 millones y una veintena de puestos de trabajo, LV Energy Lumins, que se dedica a la fabricación de paneles solares fotovoltaicos, abrió oficialmente sus puertas en el Parque Industrial Sur de la ciudad de San Luis, Provincia de San Luis.

“Exxon anunció un superpozo en Vaca Muerta”, publicado por El Inversor Energético y Minero el 21/05/2014.
La compañía ExxonMobil Exploration Argentina anunció el descubrimiento de gas y petróleo no convencional en un pozo ubicado en el área de la formación de Vaca Muerta, en la provincia de Neuquén. "Este primer descubrimiento operado por ExxonMobil en la formación de Vaca Muerta es una señal muy positiva de que el shale en esta área de la provincia de Neuquén constituye una gran promesa de recurso no convencional rico en líquidos en la Argentina", expresó el presidente de la compañía, Stephen Greenlee.

“YPF confía en haber hallado otro Vaca Muerta en Chubut”, publicado por Ámbito Financiero el 22/05/2014.
El titular de YPF, Miguel Galuccio, y el gobernador de Chubut, Martín Buzzi, anunciaron ayer el primer descubrimiento, por parte de YPF, de hidrocarburos no convencionales -shale oil y shale gas- en la formación D-129 del yacimiento El Trébol, ubicada en la Cuenca del Golfo San Jorge, Provincia de Chubut. Aunque para estimar la producción del hallazgo aún resta determinar el verdadero potencial del área explorada, tanto la empresa como la provincia no ocultan su entusiasmo frente a lo que podría ser un hallazgo similar al de Vaca Muerta en Neuquén.

“Vaca Muerta tiene gas para 400 años, dice Estados Unidos”, publicado por Clarín el 25/05/2014.
Daniel Poneman, Subsecretario de Energía de los Estados Unidos, dijo que la reservas de Vaca Muerta “representan una oportunidad única” para Argentina. Además, añadió que “según nuestra información, Argentina tiene reservas de shale gas equivalentes a 800 TCF. Hoy, el país consume el equivalente a 1,5 TCF (trillones de pies cúbicos) de gas por año. Si no tuviera restricciones, podría llegar a consumir 2 TCF, según técnicos locales. Así, según las estimaciones de la Agencia de Información Energética de los EE.UU., las reservas de combustibles no convencionales como las de Vaca Muerta alcanzarían a abastecer el consumo nacional por unos 400 años.

“Abren ofertas para construir la represa Chihuido I”, publicado por El Inversor Energético y Minero el 26/05/2014.
El Ministerio de Planificación Federal abrirá los sobres con las ofertas económicas para la construcción del aprovechamiento multipropósito Chihuido I, sobre el río Neuquén, que demandará una inversión de casi 1.900 millones de dólares y concitó el interés de empresas locales así como de Brasil, Rusia, Estados Unidos y China. La nueva represa y central hidroeléctrica se ubicará a 155 kilómetros de la ciudad de Neuquén y permitirá controlar las crecidas fluviales, además de aportar una potencia instalada de electricidad de 637 megawatts (Mw).

 “Madalena Energy compró los activos de Gran Tierra en la Argentina por USD 63 millones”, publicado por El Inversor On Line el 30/05/2014.
La petrolera independiente Madalena Energy, con sede en Calgary (Canadá), que en el país posee una serie de concesiones con potencial no convencional en la cuenca Neuquina, cerró ayer la compra de los activos de Gran Tierra Energy, también de origen canadiense, en la Argentina. La operación se concretó por un monto de 63 millones de dólares. Con presencia áreas de la cuenca Neuquina en las que está explorando oportunidades en el shale de Vaca Muerta, Madalena sumará ahora campos convencionales con una producción cercana a los 2610 barriles diarios de petróleo equivalente (un 78% de crudo), por lo que su oferta diaria de hidrocarburos ascenderá a 3570 bep/d en la Argentina, según informó la empresa a través de un comunicado.
