Dos Juzgados de Primera Instancia resolvieron en contra del DNU 669/19

Desde su sanción, dos Juzgados Laborales se han expedido en contra del DNU 669/2019, que modificó el índice de actualización para el ingreso base en accidentes de trabajo.

En primer lugar, el 9 de octubre de 2019, el Juzgado Nacional de Primera Instancia del Trabajo N° 76 hizo lugar a la medida cautelar solicitada en el marco del amparo presentado por el CPACF contra el DNU 669/19. La resolución emitida en autos “Colegio Público de Abogados de la Capital Federal c/ Estado Nacional Poder Ejecutivo Nacional s/Acción De Amparo” resolvió suspender la aplicación del DNU hasta tanto se resuelva la acción de fondo.

En la misma fecha, el Juzgado Nacional de Primera Instancia N° 41 dictó sentencia en el caso “Fernandez Miguel Ángel V. Experta Art SA S/Accidente – Ley Especial” y declaró inconstitucional e inconvencional el DNU.

El DNU, dictado el 30 de septiembre de 2019, había modificado la tasa de actualización del ingreso base para las indemnizaciones por incapacidad laboral definitiva o muerte del trabajador, establecida en el artículo 12 de la Ley de Riesgos del Trabajo N° 24.557. Había dispuesto que, desde la fecha de la primera manifestación invalidante hasta la fecha en que debiera ponerse a disposición de la indemnización por parte de la ART, el ingreso base se actualizaría por aplicación del índice de actualización RIPTE (que es un índice menor), en vez de la tasa activa cartera general nominal anual vencida a treinta (30) días del Banco Nación (que era una tasa más alta en el último tiempo). Recordemos que dicha tasa había sido introducida a la LRT en el año 2017 con el dictado de la Ley 27.348.

Emergency Decree No. 669/2019

Since it was enacted, two Labor Courts have issued resolutions against the Emergency Decree No. 669/2019, which modified the update rate of the basic income for the calculation of the compensation in work-related accidents.

Firstly, on October 9, 2019, First Instance Labor Court No. 76 ruled in favor of the precautionary measure requested in a protective action filed by the Buenos Aires Bar Association against the Emergency Decree No. 669/19. The resolution issued in the case “Buenos Aires Public Bar Association v. National State Executive Power re. Protective action” decided to suspend the application of the Decree until the protective action is resolved.

In the same date, First Instance Labor Court No. 41 issued a sentence in case “Fernandez Miguel Angel v. Experta ART S.A. re. Accident”, and declared the Decree unconstitutional and unconventional.

The Banco de la Nación Argentina 2018 active rate amounted to 40.63%, whereas the RIPTE rate was of 27.1%. Consequently, the Decree reduces the update of the compensations to be paid in the abovementioned cases.

The Decree, issued on September 30, 2019, had modified the update rate of the basic monthly income used for the calculations of the compensations granted to the employees for definite labor disability or death, established in Section 12 of the Labor Risks Law No. 24,557. It had provided that, from the date of the first appearance of the inability until the date on the ART has to provide the compensation for determination of the definite labor incapacity, the basic monthly income would be updated by application of the RIPTE rate (which is a lower rate), instead of the active annual nominal general portfolio rate due thirty (30) days from the Banco de la Nación Argentina (which had been a higher rate lately). It is important to highlight that this rate had been introduced to the Labor Risks Law in 2017 with the enactment of Law No. 27,348.
