| Argentine PTO: Statistics for 2015 |
| |
The Argentine PTO released the data for patent, design patent, utility model and trademark filings (including oppositions) for 2015, thus providing a basis for comparison with the activity carried out in 2014.

| INTA Committee’s Appointments |
| |
Several members of the firm have been appointed by the International Trademark Association (INTA) as members of their committees for the 2016-2017 term. In particular, Iris V. Quadrio was appointed Chair of the International Amicus Committee, Gustavo P. Giay was appointed Co-Chair of the Global Advisory Council Latin America and member of the Data Protection Committee, and Martín G. Chajchir was appointed Co-Chair of the Features Subcommittee of the INTA Bulletins Committee.
In addition, Sergio Ellmann, Juan M. López Mañan, Verónica Canese and Diego Fernández have been appointed to serve on the following committees: Trademark Harmonization, Public and Media Relations, Design Rights, and Internet, respectively.
Their appointment is effective beginning January 1, 2016 and will conclude on December 31, 2017.

| Argentina: Mediation Will No Longer Suspend the One-year Term to Settle Trademark Oppositions |

The Argentine Congress passed Law No. 27,222 which provides that mediation proceedings do not suspend the one-year term to settle trademark oppositions. The new law amends Mediation Law No. 26,589 and Trademark Law No. 22,362, and will become effective on March 22, 2016.

The Argentine Congress passed a new Civil and Commercial Code that came into effect on August 1, 2015. El Instituto Nacional de la Propiedad Industrial, de Argentina, dio a conocer las estadísticas relativas a las presentaciones de solicitudes de patentes, marcas (incluso oposiciones) y modelos (de utilidad e industriales) durante 2015, lo que permite establecer una comparación con la actividad desplegada en 2014.

| Argentina: la mediación no suspende más el plazo para resolver oposiciones a solicitudes de marcas |

El Congreso argentino dictó la Ley N° 27.222 que establece que el inicio del procedimiento de mediación no suspende el plazo de un año para resolver oposiciones. La nueva ley modifica la Ley de Mediación N° 26.589 y la Ley de Marcas N° 22.362, y entrará en vigencia el 22 de marzo de 2016.

| Argentina: extranjeros no deberán prestar más caución de arraigo en juicio |

El Congreso de la Nación Argentina sancionó un nuevo Código Civil y Comercial, el cual entró en vigencia el 1º de agosto de 2015. Entre los numerosos cambios en materia civil y comercial, el código introduce nuevas regulaciones sobre derecho internacional privado, incluyendo el principio de igualdad de trato para los extranjeros.

El 1° de diciembre de 2015 entró en vigencia la Resolución N° 109/2015 de la Dirección Nacional del Registro de Dominios de Internet, entidad que tiene a su cargo el sistema de registros de nombres de dominio en Argentina, por la cual se aprobó la creación de tres nuevas extensiones y los nuevos aranceles para el registro de nombres de dominio bajo el código país “.ar”.

La Sala 3 de la Cámara Federal de Apelaciones en lo Civil y Comercial Federal resolvió que no toda infracción marcaria hace presuponer la generación de un daño por lo que, quien lo invoca, debe probar su existencia.

La Sala 2 de la Cámara Federal de Apelaciones en lo Civil y Comercial sostuvo que son nulas las marcas registradas para su venta por quien tiene como actividad habitual el registro a ese sólo efecto.
