New Regime for Private Wireless Broadband Systems 

The Argentine Communications Agency (ENACOM) published Resolution 1111/2025 in the Official Gazette on August 25, 2025, allocating the frequency band between 2300 and 2400 MHz to the mobile service with primary status and repealing the allocation to the fixed service in the 2390–2400 MHz range.

Following the Resolution, the 2300–2400 MHz band will be used to implement new systems called Private Wireless Broadband Systems (SPIBA). However, the Resolution strictly prohibits using these systems or their authorized frequencies to provide Information and Communications Technology (ICT) Services of any kind.

The recitals of the Resolution emphasize that these systems could be applied to machine-to-machine communications, public protection, disaster mitigation, intelligent transportation, autonomous driving, energy networks, resource management, industrial automation, surveillance, and sectors such as mining, ports, healthcare, agriculture, oil and gas industries.

The Resolution defines the SPIBA as a mobile access radiocommunication system, based on digital technology and frequency cellular reuse, intended for data transmission and/or broadband Internet access. Its owner uses it privately as a complement to their specific activity, without involving third-party subscribers.

The Resolution also approves a procedure for assigning radio channels for the SPIBA under two main modalities, “General” and “Interior:”

•    In the case of General SPIBA, ENACOM will publish the frequency request in the Official Gazette and on its website, opening a period of 30 calendar days for third parties to apply. If the applications do not exceed the availability of channels, the authorization will be granted after the interested party pays the applicable fee. If there are more interested parties than available channels, an auction procedure will be held, and the authorization will be awarded to those who submit the best economic proposal.

•    In the case of an Interior SPIBA, channels are assigned on demand, subject to verifying the documentation the interested party submits and the payment of the applicable fee within 30 calendar days of receiving the notification.
In both cases, to file the request, applicants must submit documentation and information that includes, among other information, the applicant’s details, a description of the operating area, the equipment they will use, and the technical specifications of the base stations.

In addition, the Resolution sets the applicable fees for assigning radio channels and establishes that SPIBA authorizations may be renewed at the request of the holder, if the holder submits the application at least six months before the expiration date.

Finally, this regime will come into effect 60 calendar days after its publication in the Official Gazette.
